9-2-3: PRIVATE WASTEWATER DISPOSAL:
   A.   Connection To Private System: Where a public sanitary or combined sewer is not available under the provisions of subsection 9-2-2D of this chapter, the building sewer shall be connected to a private wastewater disposal system complying with the provisions of this section.
   B.   Permit Required; Fee:
      1.   Before commencement of construction of a private wastewater disposal system, the owners shall first obtain a written permit signed by the mayor. The application for such a permit shall be made on a form furnished by the town, which the applicant shall supplement by any plans, specifications, and other information as are deemed necessary by the council.       2.   A permit and inspection fee of one thousand dollars ($1,000.00) shall be paid to the town at the time the application is filed. (1993 Code § 13.12.030; amd. 2014 Code)
   C.   Inspection And Approval: A permit for a private wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the superintendent. The superintendent shall be allowed to inspect the work at any stage of construction, and, in any event, the applicant for the permit shall notify the superintendent when the work is ready for final inspection, and before any underground portions are covered. The inspection shall be made within twenty four (24) hours of the receipt of notice by the superintendent.
   D.   Construction And Location: The type, capacities, location and layout of a private wastewater disposal system shall comply with all recommendations of the Wyoming department of environmental quality. No permit shall be issued for any private wastewater disposal system employing subsurface soil absorption facilities where the area of the lot is less than 0.5 acre or where the absorption facility is within one hundred feet (100') of a municipal or domestic well. The lot shall be of such configuration so that a minimum one hundred foot (100') diameter circle can be inscribed within the boundaries of the lot. No septic tank or cesspool shall be permitted to discharge to any natural outlet.
   E.   Connection With Public Sewer When Available: At such time as a public sewer becomes available to a property served by a private wastewater disposal system, as provided in subsection 9-2-2D of this chapter, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tanks, cesspools, and similar private wastewater disposal facilities shall be abandoned, cleaned of sludge and filled with suitable material all within thirty (30) days after date of official notice to do so.
   F.   Sludge And Grease Removal: The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times, at no expense to the town. All sludge and grease removable from private disposal systems will be performed by properly licensed operators and disposed in strict conformance with Wyoming department of environmental quality regulations.
   G.   Additional County Requirements: No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the county health officer. (1993 Code § 13.12.030)
