(A) In order for a city street eligible under § 70.42 to have a speed hump constructed thereon, the following criteria must first be met:
(1) Delivery to the City Administrator of a petition signed by not less than a total of five SFRs, and/or MFRs, or a combination thereof, from the affected street segment where the proposed speed hump is to be installed; a residence is affected if it is located upon the street segment.
(a) A homeowners association may also submit a petition for a street within their neighborhood.
(b) A business owning property shall be considered as an SFR.
(2) The petition shall contain the following information:
(a) A caption that includes, in bold font, at least 14 point, “A PETITION TO INSTALL SPEED HUMP(S) ON [name of street or road] STREET/ROAD”;
(b) The legibly printed name, address, and signature of each petitioner and date;
(c) One petitioner shall be identified as a sponsor, for which the city will use as a primary contact person;
(d) A description of the affected street segment, either by listing the addresses or address range of the residents along the segment, or a description of the starting point and stopping point of the affected street segment.
(3) Based on the received petition, the city will determine the speed hump location along the street. If multiple petitions are received at one time for a street, the city may consolidate the petitions into one petition.
(a) The city will make a preliminary determination of eligibility by obtaining traffic data in a timely matter at the proposed location of the speed hump.
(b) The city may conduct additional transportation engineering studies, including but not limited to traffic volume, accident, and speed studies, and solicit comments and recommendations of other agencies, including but not limited to emergency service. A determination of the street eligibility for speed hump installation, with or without city funding, will be made, in writing and in a timely manner, to the applicant’s sponsor based on this subchapter.
(c) The city will make a determination of the total design, engineering and installation costs according to this subchapter. Upon review by and prior to any final action by the Commission, the applicant sponsor will be notified, in writing, providing full details regarding the number of speed humps, location of speed humps, and estimated costs as determined by the city. If professional services are required, then the city may request a higher cost than stated below to recoup the professional fees or require a professional opinion to be submitted by the sponsor.
(d) If a speed hump location does not obtain an 85th percentile speed in excess of the speed limit, then the petition may proceed without city funding.
(B) If the above criteria have been satisfied, the city shall prepare and deliver a notice and ballot relative to the street hump to those persons entitled to vote as provided in § 70.44.
