§ 72.25 IMPOUNDMENT OF VEHICLES AUTHORIZED.
   All police officers of the city are empowered to authorize the impoundment of a vehicle violating vehicle-related ordinance and laws of Kentucky and the United States after a citation has been issued.
   (A)   Removal of abandoned or illegally parked vehicles. All motor vehicles abandoned or illegally parked on the public streets and ways of the city, shall be removed at the direction of the Police Department and shall be placed in custody of city tow lots.
   (B)   Removal of vehicle by owner-operator.
      (1)   An abandoned or illegally parked vehicle may be removed by the owner or operator of the vehicle at any time prior to the vehicle becoming physically attached to a wrecker or tow truck.
      (2)   After a vehicle has been physically attached to a wrecker, but before the wrecker has left the scene, the owner or operator of the vehicle may take possession of the vehicle only on payment to the wrecker driver of a fee in return for which the wrecker driver shall issue a release to the owner or operator.
         (a)   Neither the removal of a vehicle by an owner or operator as referred to in division (B)(1) nor the issuance of the release referred to in division (B)(2) shall be construed as relieving the owner or operator of any such vehicle from responsibility for any violation of the traffic code with which he or she may be charged.
         (b)   A vehicle slated for impoundment will be tagged and placed under control of the Simpsonville Police Department. Should a vehicle be moved without the consent and approval of the Police Department a warrant can be requested of the local prosecutor.
         (c)   All fines, fees and charges must be paid in full before a release of impoundment can be issued for the vehicle’s release.
