Each bidder for said franchise shall submit its bid and shall base such bid on the following information:
(A) The city will establish, by ordinance, mandatory garbage collection within the city. The city may also adopt mandatory or optional collection of recyclable materials within said ordinance; however, failure to adopt or implement a system of collection of recyclable materials shall not affect or invalidate any bid form, resolution, ordinance, notice of contract regarding the franchise. The city will pay the franchise recipient, the "franchise holder," based on the actual number of customers paying each month, less 25 free customers referred to in division (E) of this section.
(B) The franchise holder shall be required to provide pickup service for household residential garbage; including large appliances and furniture to be set out with a limit of one large piece per month for each residential customer at curb side in front of the property, or at an alley or other accessible public way if convenient for the property owner.
(C) The franchise holder shall be required to empty designated containers, to be provided by the commercial customer, or one roll cart, provided by the franchise holder, for each commercial customer at curb side in front of the property, or at an alley or other public way if convenient for the property owner, one time per week. Should any commercial establishment regularly exceed the designated containers or roll cart, said commercial establishment shall have the right to refuse regular pickup and said commercial establishment will be required to dispose of garbage, trash, or refuse through a hauler providing commercial dumpster service. Such commercial customers utilizing dumpsters shall contract directly with a hauler of their choice outside of the terms of the franchise, with the city's chosen franchise holder being given preference if feasible.
(D) The franchise holder shall pay the city a franchise fee per customer or a percentage of the gross revenue collected in the city, including both residential and commercial fees (excluding dumpster fees). Payment shall be retained by the city monthly from revenues collected for the preceding month. Should any fees be paid directly to the franchisee for service in the city, the franchisee shall pay the franchise fee to the city per the contract for revenues collected in the previous month. A monthly accounting report of all commercial fees collected shall be required with the payment.
(E) The franchise holder shall provide, free of charge to the city, free pick-up of city dumpsters as per the contract. The franchise holder shall further provide, free of charge, service to 25 additional residential customers each month, which includes low-income, need-based customers/city residents. Persons wishing to receive benefit of such free service shall make written request to the city. The City Commission shall designate a person or agency to determine which applicants are entitled to said free service.
