3-3-2: COLLECTION SERVICE:
   A.   The town of Simla, through its board of trustees, is authorized to enter into an exclusive contract or agreement with any qualified person or entity for the collection and disposal of garbage and refuse throughout the town. The term for the agreement shall be set by the board and the board shall set such bid qualifications, requirements, and procedures, as the board in its sole discretion determines to be in the best interests of the citizens based on all circumstances.
   B.   The refuse contractor with whom the town contracts shall furnish garbage and refuse collection service to all persons and businesses residing or located within the town boundaries. Each residence and/or business shall receive the service and shall be billed for such service regardless of whether the resident or business uses the service or not.
   C.   The services to be provided by the refuse contractor, including the providing of refuse containers, pick up times, scheduling of rates and charges, the liability insurance to be carried by the refuse contractor, and the rules and regulations set forth by the refuse contractor, shall be established in the agreement between the town and the refuse contractor. The refuse contractor shall provide each residence and business with such information prior to commencing service. Further copies of the rules and regulations, together with the agreement between the town and the refuse contractor shall be on file for examination at the office of the town clerk.
   D.   The town may, by agreement with the refuse contractor, be the collection agent for the garbage and refuse collection service. In such event, the town shall be compensated for such service by the refuse contractor in an amount to be set by the agreement between the town and the refuse contractor. Further, the charges for the service shall be included in the monthly water and wastewater charges assessed by the town to each residence and business. The same billing dates, delinquency findings, late charges, fees, and remedies as set forth in section 6-3A-11 of this code concerning the water service shall apply in the assessment and collection of monthly charges for the garbage collection service.
   E.   In the event a renter, relative, or someone other than the owner of a residence or business refuses or is unable, for any reason to pay the charges for refuse and garbage removal, the owner of the property, shall ultimately be responsible for the payment of the charges.
   F.   The dumping of rubbish and solid wastes within the town shall be prohibited except as may be established in the agreement between the town and the refuse contractor.
   G.   No collection of radioactive materials, agricultural or industrial chemical wastes, sludges, septic tank pumpings, animal carcasses or similar organic material, or other hazardous wastes shall be included in the collection service. (Ord. 246, 10-5-2004)
