7-7-3: RESIDENTIAL PROPERTY:
   A.   A single shipping container is allowed on parcel which has a permanent residential dwelling subject to the following conditions:
      1.   Foundations and footings are required for containers that are repurposed for use as a permanent building or structure.
      2.   No more than one (1) container is allowed on a parcel of land.
      3.   Containers shall not be stacked above the height of a single container and no other materials may be stacked on top of the shipping container.
      4.   Containers shall resemble the principal occupied structures. Without limiting the generality of the foregoing, such resemblance shall include a similar color.
      5.   Containers shall be in an approved designated area on the parcel, behind the primary structure, on the same property as the principal use and will be included in the calculation of overall lot coverage. All setback requirements for dwellings shall be honored unless a variance is granted by the Board
      6.   No container may be placed on a vacant parcel of land.
      7.   Semi-truck trailers are not allowed to be used as storage containers.
   B.   A property owner requesting more than one permanent container on a residential property may potentially be permitted to do so by special review upon approval of the Town Board of Trustees, subject to the following procedure and criteria:
      1.   Applications for this review shall be submitted with a building permit to the Town Clerk at least fifteen (15) days before the regular or special meeting of the Town Board of Trustees at which the request is to be considered.
      2.   The permit must include a site plan, plan for footers, foundation, and anchoring. The permit shall address the appearance of the container by photograph or other means.
      3.   The Town Board of Trustees shall review the request in relation to the health, safety, and general welfare of the community and the character of the surrounding neighborhood, and the desirability and need for such proposed structure.
      4.   The Board of Trustees shall make a decision of approval, of approval with conditions, or shall deny the application.
      5.   If more than one container is allowed and are placed side by side each other they must be engineered and attached.
      6.   If they are placed apart from each other a minimum of three (3) feet is required between each container. The Board shall consider the request based on both safety and aesthetics of the neighborhood as well as comment from neighboring landowners.
      7.   Approval of a special review request shall be valid for a period of one (1) year. If the container(s) has not been placed within one (1) year, the Board's approval for that permit shall be considered void. (Ord. 321, 1-12-2021)
