1-6-1: APPOINTED TOWN OFFICERS:
   A.   Town Clerk And Treasurer: The office of town clerk and treasurer, as defined in Colorado Revised Statutes 31-4-305, shall be filled by a sole person performing both duties unless the board at a future date determines that it is in the best interests of the town to have the separate office of clerk and of treasurer. The town clerk shall be appointed at the first regular meeting following the election of the mayor and trustees and shall serve until the next regular election at which time he or she may be released or reappointed at the discretion of the board. The town clerk shall attend all meetings of the board and make a true and accurate record of all the proceedings, rules, and ordinances made and passed by the board. The town clerk shall have such further duties as may be assigned by the board and as set forth in the written job description of the town clerk which is incorporated herein by reference.
   B.   Town Attorney: The office of town attorney, as defined in Colorado Revised Statutes 31-4-304, shall be filled by a person licensed to practice law in the state of Colorado and meeting such other legal requirements as the board may impose. The town attorney shall advise the board and other appointed officers of the state and local laws, shall enforce this code and town ordinances, and perform such other duties as requested or required by the board from time to time. The town attorney shall be appointed at the first regular meeting following the election of the mayor and trustees and shall serve until the next regular election at which time he or she may be released or reappointed at the discretion of the board.
   C.   Chief Of Police: The office of Simla chief of police, as defined by Colorado Revised Statutes 31-4-306, shall be filled by a person trained and licensed, if necessary, as a law enforcement officer in the state of Colorado. The chief of police shall have the same power that sheriffs have by law as to offenses committed within the town limits and shall execute all writs and processes directed to him or her by the municipal judge in any case arising under a town ordinance, or code. The chief of police shall have such further duties as may be assigned by the board and as set forth in the written job description of the town chief of police which is incorporated herein by reference. The town chief of police shall be appointed at the first regular meeting following the election of the mayor and trustees and shall serve until the next regular election at which time he or she may be released or reappointed at the discretion of the board.
   D.   Such other Town officers which are not designated by state statute, but are deemed to be essential by the Board, shall be appointed by the Board of Trustees at the first meeting of the new Board following each general election. A new office my be filled by appointment at such time as the Board, by majority vote, deems it to be in the Town’s best interest to create the new office. Each appointment shall require a majority vote of the Board of Trustees; provided, however, that in case of a tie vote of the Board of Trustees for any candidates for any of the said offices, the Mayor shall have the power to determine such tie vote by casting his or her vote for any candidate who has already received not less than three (3) votes of the Board of Trustees. The officers shall hold their respective offices until their successors are duly appointed and qualified. Vacancies shall be filled by appointment of the Board.  (Ord. 299, 4-8-2014; amd.
