6-7-4: EXISTING WELLS:
Those wells which are owned and operated by private persons within the Town as of the effective date of this Ordinance and which are drawing water from the Big Sandy Creek alluvium may continue to operate and draw water as before and said wells may be repaired or rehabilitated. However, said use or quantity of water drawn may not increase and the well may not be substituted, relocated or otherwise moved by the owner or operator. If an existing well ceases to function because of a drop or decrease in the alluvium water table, such well may not be replaced unless the owner applies for and is granted the right to drill into the Arapahoe and Laramie-Fox Hills Aquifers or other similar deep- water aquifer. The Town may adopt such regulations as are deemed to be necessary to ascertain and establish the use and/or quantity of water used by the existing private wells located within the Town Boundaries.
