6-3A-8: WATER RATES AND CHARGES:
The town is imposed with the duty of providing certain municipal services within its boundaries, including the provision of water to its citizens. In order to pay for the Simla water improvement project, promote orderly development, protect the health, safety and welfare of its citizens, and to maintain self-supporting water facilities for the benefit of the community, certain rates, charges, levies and regulations are hereby imposed.    A.   Residential Rates Within The Town Of Simla:
      1.   November 1 to April 30 of each year:

Further, any out of town user who uses or obtains water from within the town and conveys the water out of the town, in bulk, whether by vehicle or otherwise, shall be required to pay the sum of fourteen dollars ($14.00) for each one thousand (1,000) gallons of water used. Bulk users may apply to the board for a variance when there exist valid reasons for a variance. Each application shall be considered on a case by case basis by the board.
The town hereby declares its stated policy of supplying all in town needs before allowing the conveyance of water outside of the town limits. Accordingly, the town reserves the right, upon proper notice, to terminate service to any out of town user should any emergency or unforeseen problem arise which necessitates the use of the municipal water supply strictly to town residents or should circumstances occur which mandate that the water supply be used solely for in town use.    D.   Multiple Units: When there are multiple dwelling units which are connected by only one tap to the main water line, e.g., apartments, mobile home parks, etc., each occupied unit will be treated as a residence, subject to the above stated minimum residential rates. The owner of the property shall be responsible for establishing with the town clerk whether or not a particular unit is occupied and the dates of occupation. (Ord. 198, 9-4-1996)
   E.   Availability To Serve: Vacant property with a tap connection to the town main, regardless of use or nonuse of the town water supply, shall be metered and will be required to pay a monthly rate. Nonuse of the town water supply shall result in an assessment of the minimum rate of nine dollars fifty cents ($9.50) per month. (Res. 198-2014, 1-14-2014)
   F.   Adjustments: On an annual basis, commencing on January 1, 2006, those rates referred to in subsections A, B, and C of this section, shall be adjusted by the amount of any increase of the previous year's Denver-Boulder consumer price index with no further action of the board of trustees. The annual adjustment shall continue to take place, thereafter, in the January billing. The adjusted rate increase, upon computation by the town, shall be placed in this section for review by the town citizens and other interested parties. (Ord. 259, 9-12-2006)
