6-1-6: CONSTRUCTION OF CURBS, GUTTERS AND SIDEWALKS:
   A.   Construction Specification: Specifications adopted by the board of trustees for curbs, gutters and sidewalks shall include the form and dimensions, the type of materials used in construction, the grade upon which such construction shall be laid and the location of such curbs, gutters or sidewalks, including curb cuts and corners.
The board of trustees have set specifications for construction of curbs, gutters and sidewalks. A copy of the same is on file in the office of the Town Clerk and Recorder for public inspection. (Ord. 183, 5-7-1991; amd. Res. 95-99, 1-5-1999)
   B.   Permit Required: Any person who wishes to construct or cause to be constructed, curbs, gutters, or sidewalks on or adjacent to the dedicated streets or alleys of the Town shall first obtain a permit for such construction from the Town Building Inspector Code Enforcement Official who shall, prior to issuing such permit, determine that the proposed construction is in conformity with specifications for such construction as previously adopted by the Board of Trustees.    C.   Compliance With Provisions: No curbs, gutters or sidewalks shall be constructed on or adjacent to the dedicated streets or alleys of the Town which shall not conform to the specifications for curbs, gutters and sidewalks as adopted by the Board of Trustees.
   D.   Unlawful Construction: Any person making or causing to be made any construction in violation of the terms of this Section shall be required to remove such construction within a reasonable period of time, and failing to do so, shall be required to pay the costs of removal which may be incurred by the Town upon order by the Board of Trustees.
   E.   Repair By Town; Assessment: When the Town Board deems it necessary that any portion of a sidewalk, curb and gutter, be constructed or repaired by the owner of the adjacent or abutting property upon written notice, within one hundred eighty (180) days after receipt thereof, the Town may construct or repair the same, assess the cost thereof against the adjacent property owner, and collect the assessment as provided in this Code.
