139.18 COURT LEAVE.
   (a)   The Village of Silver Lake shall grant court leave with full pay to an employee who:
(1)   Is summoned for jury duty by a court of competent jurisdiction, or ;
(2)   Is subpoenaed to appear before any court, commission, board or other legally constituted body authorized by law to require the attendance of witnesses, where the employee is not a part to the action. A copy of the subpoena or call to jury duty must be presented to the Village, in advance, in order to be eligible for this benefit.
   (b)   Any compensation or reimbursement for jury duty or for court attendance compelled by subpoena, when such duty is performed during an employee’s normal working hours, shall be remitted to the Clerk-Treasurer of the Village of Silver Lake.
 
   (c)   The employee may choose to retain all monies received as compensation for court service and waive his/her regular salary or wage in full for such time from the Village.
   (d)   Employees appearing in court in connection with their official capacity with the Village shall receive their appropriate rate of pay.
 
   (e)   The employee will be expected to report for work following the court appearance or jury duty if a reasonable amount of time remains during his/her scheduled workday.
 
   (f)   An employee who is called for court jury duty or subpoenaed to testify in a court of law, outside of his/her regularly scheduled work hours and receives no other wage compensation from the Village of Silver Lake for such appearance, shall retain all monies received as compensation for such court service.
   (g)   Employees who appear in court for criminal or civil cases, where the case is being heard in conjunction with the employee’s personal matters, such as traffic court, divorce proceedings, custody, or appearing as directed as parent or guardian of a juvenile, etc., are not entitled to court leave. The employee must use either holiday compensatory leave (Police Department only), vacation leave or leave without pay at the discretion of the employee.
