1301.01 MORE RESTRICTIVE STANDARDS TO PREVAIL.
It is the purpose of this Building Code to regulate the erection, construction, alteration, repair, enlargement, remodeling, height, area, demolition, moving, use, maintenance and occupancy of buildings and structures in the Village. Where a conflict appears to exist in the applications of the provisions of this Code with other Village ordinances, then the more restrictive application of the provisions of this Code or the other ordinances shall prevail. In the event exception is taken by the owner, builder or any other persons or company to the decision of the Building Inspector as to the "more restrictive application" as referred to above, then the Building Inspector, after consulting with the Planning Commission of the Village, shall so notify the party or parties taking the exception, in writing, which written directive shall be final in regard to the interpretation of the intention of the Code. This written directive shall apply to the "exception" in question only and shall not apply to future exceptions that shall be taken by the aforesaid party or others.
