1177.99 PENALTIES.
   (a)   Whoever violates any section of Title Seven; Subdivision Regulations, or any rule promulgated by the Village Engineer regarding standards of construction and materials, or fails to comply with an order of the Village Engineer, Clerk or Building Inspector, is guilty of misdemeanor of the 4th degree for a first offense.   If a second violation occurs by the same offender within two years that person is guilty of a misdemeanor of the first degree.
 
   (b)   Whoever violates any section of these regulations or fails to comply with an order of the Village Engineer, Clerk, or Building Inspector pursuant thereto is creating a nuisance, and the creation thereof may be enjoined by an action of suit by the Municipality.
 
   (c)   Whoever, being the owner or agent of the owner of any land within the Village, leases or transfers any lot, parcel or tract of such land from or in accordance with a plat of a subdivision, before such plat has been recorded in the office of the County Recorder shall forfeit and pay the sum of not less than $250.00 nor more than $1,000.00 for each lot, parcel or tract of land so sold. The description of a lot, parcel or tract by metes and bounds in the deed of transfer shall not serve to exempt the seller from the forfeiture provided in this section. Such sum may be recovered in a civil action filed in the Court of Common Pleas of Summit County, by the legal representative of the Municipality, in addition to any other criminal or civil remedies available under law.
