927.01 DEFINITIONS.
   (1)    "Act" means the Federal Pollution Control Act, also known as the Clean Water Act, as amended, 33 U.S.C. 1251, et seq.
 
   (2)    "Beneficial User" means, but is not limited to, domestic, municipal, agricultural and industrial use, power generation, recreation, aesthetic enjoyment, navigation, and the preservation and enhancement of fish, wildlife, and other aquatic resources or reserves, and other uses, both tangible and intangible, as specified by State or Federal law.
 
   (3)    "Benefit" means a sewage or wastewater discharge of 400 gallons per day which is the estimated flow from a single-family dwelling.
 
   (4)    "Biochemical Oxygen Demand (BOD)" means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at twenty (20) degrees centigrade expressed in terms of concentration (milligrams per liter (mg/l) or parts per million (ppm)). The oxygen demand measured is the sum of carbonaceous and nitrogenous demands. Laboratory procedures shall be in accordance with "Standard Methods."
 
   (5)    "Building Drain" means all piping within a building which collects wastewater to be conveyed to the private sewer lateral. The building drain and private sewer lateral connection point is three (3) feet measured perpendicular from any outside wall of the building.
 
   (6)    "Combined Sewer" means a sewer designed to receive and transport both sanitary sewage and storm water runoff.
 
   (7)    "Commercial User" means any user of the sewage system not categorized as residential, institutional, governmental or industrial, but not limited to, wholesale or retail trade establishments, general business offices, food services and health services.
 
   (8)    "Contractor" means a person retained by a property owner, developer or governmental body to construct a sewage disposal system.
 
   (9)    "Control Manhole" means a structure which provides access to a sewer lateral. A control manhole may be used as an inspection chamber and may contain certain testing equipment.
 
   (10)    "County" means Summit County, Ohio.
 
   (11)    "Debt Service" means the portion of the sewer service charge designated for the retirements of principal and interest on bonds, notes, loans, or other debt instruments which have been incurred or will be incurred for the construction, operation and maintenance of Village sewer system facilities.
 
   (12)    "Department of Environmental Services" means the Summit County Department of Environmental Services and its agreement for the transportation and treatment of sewage from the Village of Silver Lake.
 
   (13)    "Director" means the Director of Public Service of the Village of Silver Lake or an authorized agent or representative.
 
   (14)    "Equipment Replacement Cost". See "Replacement."

   (15)    "Equivalent Dwelling Unit (EDU)" means a measurement of the wastewater contributed by unmetered users representing that which is discharged by the average residential users. (Ord. 49-2019. Passed 10-7-19.)
 
   (16)    "Environmental Health Code" means the Environmental Health Code of the Summit County General Health District.
 
   (17)    "Governmental User" means any user discharging wastewater from premises utilized by public political units, including Federal, Stated, County and Municipal units.
 
   (18)    "Hundred Cubic Feet (H.C.F.)" is the amount at which water is registered by meter readings in the Village of Silver Lake. One (1) unit of water billed equals 100 cubic feet of water which represents approximately 750 gallons.
 
   (19)    "Industrial User" means a person who discharges to the Village's sewage disposal system liquid, solid, or gaseous wastes resulting from the processed employed in industrial or manufacturing activities, or from the development, recovering or processing of any natural resource.
 
   (20)    "Infiltration" means the water entering a sewer system and sewer laterals from the ground through such means as, but not limited to, defective pipes, pipe joints, connections, and manhole walls.
 
   (21)    "Inflow" means the water discharged to a sewer system and sewer laterals from such sources as, but not limited to, roof down spouts, exterior foundation drains, runaway drains, cooling water discharges, drains from springs and swampy areas, manhole covers, cross connections from storm sewers and combined sewers, catch basins, storm waters, surface runoff, street wash waters or drainage.
 
   (22)    "Institutional User" means any person discharging wastewater from premises serving educations, social or eleemosynary purposes, including, but not limited to, private schools, hospitals, nursing homes and charitable organizations.
 
   (23)    "Manhole" means a physical access point to the sewer system for the purpose of cleaning, inspection, metering, observations, etc. A manhole is sized for human and equipment access in the normal operation and maintenance of a sewerage system.
 
   (24)    "May" indicates a discretionary condition.
 
   (25)    "National Categorical Pretreatment Standard" means any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) of the Act (33 U.S.C. 1347) which applies to a specific category of industrial users.
 
   (26)   "National Pollutant Discharge Elimination System (NPDES) Permit" means a permit issued by the State of Ohio or EPA pursuant to the Act for the purpose of regulating the discharge of sewage, industrial wastes, and other wastes (under the authority of Section 402 of the Act), into navigable waters of the United States.
 
   (27)    "Normal Domestic Sewage" means wastewater created in the preparation of foods, bathing, laundry facilities and sanitary facilities, as resulting from normal individual and group living functions and characterized by a loading of 250 mg/1 BOD and 300 mg/1 suspended solids per capita.
 
   (28)    "OEPA" means the Ohio Environmental Protection Agency of the United States Environmental Protection Agency and may also be used, where appropriate, as the designation for the administrator or other duly authorized official of such agency.
 
   (29)    "Operation and Maintenance (O&M) Costs" means the current, reasonable and necessary costs of the operation and maintenance of the sewage disposal system, paid or incurred, determined in accordance with generally accepted accounting principles, including replacement costs, but excluding payments of principal and of interest on obligations issued to finance the costs of acquisition and construction of the sewage disposal system.
 
   (30)    "Person" means any individual, firm, company, municipal or private corporation, partnership, copartnership, joint stock company, trust, association, institution, enterprise, governmental agency, State of Ohio, the United States of America, or other legal entity, or their representatives, agents or assigns. The masculine gender shall include the feminine, the singular shall include the plural where indicated by context.
 
   (31)    "POTW"' means publicly-owned treatment works, that is treatment works which are owned by the Village of Silver Lake, including the sewers and pumping stations or any other POTW operated by another government entity to which the Village conveys wastewater or from which the Village receives wastewater.
 
   (32)    "Pretreatment Standard". See "National Categorical Pretreatment Standard."
   
   (33)    "Private Sewer Lateral" means that section of the sanitary sewer owned and maintained by a user which conveys wastewater from the building drain to a public sewer, public sewer lateral, or privately owned and maintained sewer extension.
 
   (34)    "Public Sewer" means a sewer provided by or subject to the jurisdiction of the Village of Silver Lake and the County of Summit.
 
   (35)    "Public Sewer Lateral" means a stack, riser, or section of sanitary sewer owned and maintained by the Village which conveys wastewater from a private sewer lateral to a public sewer.
 
   (36)    "Replacement" means any expenditure for obtaining and installing equipment, accessories or appurtenances which are necessary during the useful life of the sewage disposal to maintain the capacity and performance for which such system was designed and constructed.
 
   (37)    "Residential User" means any aggregation of space or area occupied as a residence and generating domestic wastewater. In multi-use premises, only those divisions of the building utilized as domiciles are considered residential users.
 
   (38)    "Sanitary Sewer" means a sewer which carries wastewater and to which storm, surface and ground waters are not intentionally admitted.
 
   (39)    "Sanitary Sewer Connection Permit". See "Sewer Permit."
 
   (40)    "Sewage" means the water-carried human, animal and household wastes from public or private drains, and may include groundwater infiltration, surface drainage, and industrial wastes.
 
   (41)    "Sewage Disposal System" means all facilities for collection, pumping, treating and disposing of sewage and industrial waste, as well as the wastewater treatment facilities. It shall not include plumbing inside or in connection with building drains or private sewer laterals from a building to the public sewer lateral.
 
   (42)    "Sewer" means a pipe or conduit for carrying wastewater.
 
   (43)    "Sewer Permit" means a written authorization for an excavator to construct, repair or replace a private sewer lateral and to connect the lateral to the Village sewer system or a previously constructed privately owned and maintained sewer extension.
 
   (44)    "Sewer Service Charge" means the total charge for wastewater treatment services billed to users of the sewage system. The charge shall be based on a user charge rate to cover operation and maintenance (O&M) costs and a separate rate to cover debt service/ capital improvements cost.
 
   (45)    "Shall" means mandatory.
 
   (46)    "Significant Industrial User (SIU)"means:
A.   All industrial users subject to National Categorical Pretreatment Standards; and
B.   Any other industrial standard that:
1.   Discharges an average of 25,000 gallons per day of process wastewater to the Village sewerage system;
2.   Contributes process waste streams which make up five percent (5%) or more of the average dry weather hydraulic or organic capacity of the receiving wastewater treatment plant; or
3.   Has a reasonable potential in the opinion of the Director, to adversely affect the receiving wastewater treatment plant's operation or for violating any pretreatment standard or requirement.
 
   (47)    "Standard Methods" means those laboratory procedures set forth in the most recent edition of Standard Methods for the Examination of Water and Wastewater, published jointly by the American Public Health Association, the American Water Works Association, and the Water Pollution Control Federation.
 
   (48)    "Storm Sewer" means a sewer which carries storm, surface and groundwater drainage, but excludes sewage and industrial wastes.
 
   (49)    "Storm Water Runoff " means that portion of rainfall that is or should be drained into storm sewers, storm drains, surface watercourses or surface water impoundments.
 
   (50)    "Suspended Solids (SS)" means solids that either float on the surface of, or are in suspension or will settle in water, sewage or industrial waste, and which are removable by a laboratory filtration device. Laboratory procedures shall be in accordance with "Standard Methods."
 
   (51)    "Total Solids (TS)" means the sum of suspended and dissolved solids.
 
   (52)    "USEPA" means the United States Environmental Protection Agency and may also be used, where appropriate, as a designation for the administrator or other duly authorized official of such agency.
 
   (53)    "User" means a person that discharges, causes or permits the discharge of wastewater into the sewage disposal system.
   (54)    "User Charge" means the fee imposed upon all units serviced by the sewage disposal system of the Village in a total amount sufficient to pay the costs of operation and maintenance, including the costs of replacement of equipment in the sewage disposal system.
 
   (55)    "Village" means the Village of Silver Lake.
 
   (56)    "Wastewater" means the liquid and water-carried industrial or domestic wastes from dwellings, commercial buildings, industrial facilities and institutions, together with any groundwater, surface water and storm water that may be present, whether treated or untreated, which is discharged into or permitted to enter the Village's sewage disposal system.
 
   (57)    "Watercourse" means a channel in which a flow of water occurs, whether continuously or intermittently.
