(a) Unless otherwise permitted by law, no person, regardless of intent, shall throw, drop, discard or deposit litter or cause litter to be thrown, dropped, discarded or deposited on any public property, private property not owned by him or her, or in a receptacle therein, or in waters within the municipality not owned by such person.
(b) Unless otherwise permitted by law, no person shall cause or allow litter to be collected or remain in any place to the damage or prejudice of others in or of the public, or unlawfully obstruct, impede, divert, corrupt or render unwholesome or impure, any natural watercourse.
(c) Unless otherwise permitted by law, no person, regardless of intent, shall cause, throw, drop, discard, place, deposit, blow or permit grass clippings, leaves, brush, mulch or other yard waste or snow or ice on any public property, roadway or private property not owned by him, or in any waters within the municipality not owned by such person, or in a natural watercourse.
(d) As used in this section, “litter” means garbage, trash, waste, rubbish, ashes, cans, bottles, wire, paper, cartons, boxes, automobile parts, furniture, glass or anything else or an unsightly or unsanitary nature.
(e) Whoever violates subsection (a) hereof is guilty of a third degree misdemeanor.
(f) Whoever violates subsection (b) hereof is guilty of a third degree misdemeanor, and each day of such violation shall be a separate offense.
(g) Whoever violates subsection (c) hereof shall pay to the Village, at the Office of the Clerk-Treasurer, the sum of ten dollars ($10.00), provided the same is paid within seventy-two (72) hours following the offense. After seventy-two (72) hours but no more than thirty (30) days following the offense, the resident shall pay the sum of twenty-five dollars ($25.00). Thereafter, the resident shall pay the sum of fifty dollars ($50.00). If no payment is received in forty-five (45) days following the offense the period for summary disposition of the violation will lapse and a citation to the Stow Municipal Court will be issued, where the maximum fine levied for each offense shall be fifty dollars ($50.00) plus court costs.
