(a) No person shall hunt or attempt to kill any animal or fowl within the Village by use of firearms or any other means, except as follows:
(1) A police officer or animal warden in the discharge of his or her official duties.
(2) A person authorized by the Director of Public Safety as part of a nuisance animal control program, or any other person pursuant to authority granted by state law provided the method used does not involve a projectile.
(3) Hunting of white-tailed deer, or any other wild animals, may be permitted only after receiving a Municipal Wildlife Control Permit issued by the Director of Public Safety, or his or her designee, and shall not be in conflict with state law pertaining to hunting as set forth in Chapters 1531 and 1533 of the Ohio Revised Code or rules enacted in accordance with such chapters.
(4) The criteria for issuance of Municipal Wildlife Control Permits and the rules and regulations for use shall be established. Initially, after the effective date of this section, the rules and regulations shall be as specified in Exhibit “A” attached to Ordinance 74-2017. Such rules and regulations shall not be changed unless the changes are recommended by the Director of Public Safety, and only after he or she received the advice and consent of Council, which consent shall be expressed by motion at a regular or special meeting of Council. Such rules and regulations shall not be in conflict with state law pertaining to hunting as set forth in Chapters 1531 and 1533 of the Ohio Revised Code or rules enacted in accordance with such chapters.
(5) Trapping of wild animals may be permitted only during the statewide trapping season when done in accordance with the state laws and regulations as set forth by the Chief of the Division of Wildlife and only after receiving a Municipal Wildlife Control Permit. Such permit may be issued by the Director of Public Safety in accordance with rules and regulations established as in subsection (a)(4) above and pursuant to subsection (a)(2) above.
(6) Nothing herein shall conflict with the State law regarding the elimination of nuisance wild animals, specifically Chapter 1501 of the Ohio Revised Code.
(b) Whoever violates this section is guilty of a third degree misdemeanor and a second degree misdemeanor for any subsequent offense.
