(A) Building Sewers which do not meet the standards for construction provided by § 50.062(C), including in particular Building Sewers which are not watertight and as a result either discharge Sewage to the ground or the ground water or admit ground water to the Building Sewers are hereby declared to be a Nuisance contrary to the preservation and protection of the public health, safety, and welfare of the Township.
(B) In the event the Township determines that a Building Sewer constitutes a Nuisance in accordance with division (A) above, the owner of record of the affected Premises shall replace the Building Sewer within 90 days after written notice of said determination is given by the Township and in such event the owner of the Premises shall pay all costs and expenses related to the Building Sewer replacement.
