A. This chapter shall not apply to any person camping, occupying camp facilities, or using camp paraphernalia, or to any person storing personal property, including camp facilities and camp paraphernalia, on any public property designated by the city for such purposes. The city council may, by resolution or ordinance, establish one or more specified areas of public property for such purposes.
B. The provisions of this chapter will not be enforced, except as stated below, against indigent homeless persons storing personal property, including camp facilities and camp paraphernalia, or sitting, lying, or sleeping on public property when no alternative shelter is available in accordance with the holding in Martin v. City of Boise (9th Cir. 2018) 902 F.3d1031:
1. In exigent circumstances relating to immediate threats to the public health, safety, or welfare.
2. On the following public property and related areas, including without limitation, the entirety of the real property or lot on which each of the following is located:
a. Signal Hill city hall;
b. Signal Hill public library;
c. Signal Hill Discovery Well Park Community Center;
d. Signal Hill Park Community Center;
e. Within one hundred fifty feet of an elementary school, middle school, preschool, or child care center, and within one hundred feet of a high school;
f. Within two feet of any fire hydrant, fire plug, or other fire department connection;
g. Within ten feet of any operational or utilizable driveway or loading dock; or
h. Within five feet of any operational or utilizable building entrance or exit. (Ord. 2023-11-1545 § 9 (part), 2023)
