§ 92.01 INTENT AND PURPOSE.
   It is the intent of the city to protect and promote the public health, safety and general welfare by: providing for the placement or maintenance of wireless facilities in the public rights-of-way the city; adopting and administering proper rules and regulations not inconsistent with state and federal law, including Title 9, Article 8 of Chapter 5 of Arizona Revised Statutes as it may be amended, the home-rule authority of the city, and in accordance with the provisions of the Federal Telecommunications Act of 1996, the Middle Class Tax Relief and Job Creation Act of 2012, the relevant portion of which is codified at 47 U.S.C. § 1400 et seq., and other federal and state law; establishing reasonable rules and regulations necessary to manage the placement or maintenance of wireless facilities in the public rights-of-way by all wireless providers; and minimizing disruption to the purposes of public rights-of-way. In regulating its public rights-of-way, the city shall be governed by and shall comply with all applicable federal and state laws.
