(A) Liability for costs. In addition to any court imposed fines, the city may assess liability for costs to any person in violation of this chapter for all actual costs incurred by the city in surveillance, sampling and testing, abatement, and remediation associated with a discharge. Additionally, the city may assess liability for costs to any person whose discharge resulted in the city receiving a violation to the city's AZPDES stormwater permit.
(B) Abatement by the city is subject to the procedures and penalties set forth in City Code § 91.46, Nuisance Abatement and Injunction.
