§ 95.15 NOTICE AND ORDERS.
   (A)   Notice of opportunity to comply. The city may seek voluntary compliance with the provisions of this chapter through a notice of opportunity to comply. (Conversely, depending on circumstances, nothing in this chapter prevents the city from immediately citing persons for violations of this chapter).
   (B)   Notice of violation. The city may issue a written notice of violation to any person who has violated or is in violation of this chapter. Nothing in this section shall limit the authority of the city to take any action, including emergency actions or any other enforcement action, without first issuing a notice of violation.
   (C)   Consent orders. The city may enter into consent orders, assurances of voluntary compliance, negotiated settlement agreements, or other similar documents establishing an agreement with any person responsible for the noncompliance. Documents will include specific action to be taken by the person to correct the noncompliance within a time period specified in the document, including identifying and describing the BMP and measures to use in implementing the order. These documents shall have the same force and effect as any other orders issued under this chapter and shall be judicially enforceable.
