§ 95.08 CONSTRUCTION SITES.
   (A)   All construction activities that require NPDES or AZPDES permits will be those projects that disturb one acre or more of land area or smaller land areas if part of a larger common plan of development or sale as described in 40 C.F.R. § 122.26(b)(15).
   (B)   Persons engaged in construction activities that are required to seek state ADEQ approval by submitting a SWPP and a notice of intent (NOI) to ADEQ, shall continue to provide the required documents to the state. A copy of the approved NOI shall be submitted to the city.
   (C)   Construction sites shall not cause or contribute to a violation of the AZPDES stormwater permit issued to the city. Persons causing or responsible for any pollution shall assume liability. Persons are responsible for preventing pollution to the MS4 through the use of BMPs that provide erosion and sediment control, waste control, and the proper disposal of waste (such as discarded building materials, concrete truck washout, chemicals, litter, and sanitary waste).
