§ 95.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY (ADEQ). The State Agency charged with enforcement of environmental laws and regulations.
   ARIZONA POLLUTANT DISCHARGE ELIMINATION SYSTEM (AZPDES) STORMWATER PERMIT. A permit issued by ADEQ to authorize the discharge of stormwater pursuant to Arizona Administrative Code R18-9-A902, which incorporates 40 C.F.R. § 122.32.
   BEST MANAGEMENT PRACTICES (BMPs). Schedules of activities, prohibitions of practices, maintenance procedures, and other management practices that prevent or reduce the discharge of pollutants into stormwater. BMPs also include treatment requirements, operating procedures, and practices that control site runoff, spillage or leaks, sludge or waste disposal, or drainage from outdoor storage areas.
   CLEAN WATER ACT. The Federal Water Pollution Control Act, as amended, 33U.S.C.§§1251 et seq.
   DISCHARGE. Any spilling, seeping, leaking, pumping, pouring, emitting, emptying, injecting, placing, releasing, leaching, dumping, or disposing into or on any land in a manner that may cause pollution.
   ENVIRONMENTAL PROTECTION AGENCY (EPA). The federal agency charged with enforcement of environmental laws and regulations.
   ILLICIT DISCHARGE. The common sources of illegal, non-stormwater discharges including sanitary wastewater, automobile maintenance waste products such as motor oil or antifreeze, laundry wastewater, household toxic substances, spills from car accidents, runoff from excess irrigation, and industrial sources of cooling waters, rinse water, and other process wastewater. Although these ILLICIT DISCHARGES can enter the MS4 in various ways, they generally result from either direct connections (e.g., wastewater infiltration into the washes, storm drain system or spills). ILLICIT DISCHARGES can be further divided into those discharging continuously and those discharging intermittently. ILLICIT DISCHARGES are included as pollutants.
   MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4). All or any part of the publicly-owned and maintained roads, streets, catch basins, curbs, gutters, ditches, washes, drainageways, man-made channels, storm drains, and dry wells located within public easements, right-of-way, parks, common areas, retention areas, or other publicly-owned or maintained real property designed or used for collecting, holding, or conveying stormwater.
   NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) STORMWATER PERMIT. A permit issued by the EPA which authorizes the discharge of stormwater pursuant to the Clean Water Act § 402 (33 U.S.C. § 1342).
   NOTICE OF INTENT (NOI). A form submitted to ADEQ notifying them of a person's intent to be covered under a separate AZPDES stormwater permit, as required by federal and state law.
   NOTICE OF TERMINATION (NOT). A form submitted to ADEQ notifying them of a person's intent to terminate a NOI.
   PERSON. Any individual, partnership, co-partnership, owners, operators, firm, company, corporation, limited liability company, association, joint stock company, trust, estate, purchaser under contract for sale, governmental entity, lessee, renter, or any other legal entity; or their legal representatives, agents, or assigns. Hereinafter all entities are referred to as PERSON or PERSONS.
   POLLUTANT. Shall have the same meaning as defined in 40 C.F.R. § 122.2, and includes but is not limited to any solid, liquid, gas, or other substance that can alter the physical or chemical properties of water including, but not limited to fertilizers, solvents, sludge, petroleum and petroleum products, solid waste, garbage, biological materials, radioactive materials, sand, dirt, animal waste, acids, and bases.
   PREMISES. Any building, lot, parcel, real estate, or land or portion of land whether improved or unimproved including adjacent sidewalks and parking strips.
   PUBLIC STORM DRAIN SYSTEM STORMWATER. Stormwater runoff, surface runoff, and drainage.
