§ 92.10 APPEALS.
   Final, written decisions of the City Manager or his or her designee suspending or denying a permit, denying an application for a registration or denying an application for renewal of a registration are subject to appeal. An appeal must be filed with the City Manager or his/her designee within thirty (30) days of the date of the final, written decision to be appealed. Any appeal not timely filed as set forth above shall be deemed waived. The appeal shall be reviewed in accordance with the following:
   (A)   If any person, firm or corporation is aggrieved by the ruling of the City Manager or director of public works or the City Engineer under the literal enforcement of either this Chapter or the rules and regulations which the departments from time to time promulgate, a protest in writing shall be filed by the complaining party with the City Manager.
   (B)   Such protest shall be placed upon the agenda of the City Council, and the City Council shall by majority vote enter its findings upon such appeal and the findings shall be a final ruling as to the appeal.
