1313.09   ROOFS, GUTTERS AND DOWNSPOUTS.
   (a)   All roofs, gutters, downspouts, facia, soffits, rakes and freeze boards of principal structures and accessory structures shall be maintained weather tight and in good condition. Gutters and downspouts, if present, must be firmly anchored, maintained in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. Roof timbers or members, roof covering and flashing shall be provided so as to prevent the entrance of moisture and be maintained by waterproofing or other suitable means.
   (b)   All commercial buildings within the nine-block downtown area bordered by North Street on the north, by West Avenue on the west, by South Street on the south, and by Miami Avenue on the east, are required to have gutters and downspouts servicing all roof areas of the principal structures and accessory structures. In order to prevent roof water discharge from damaging the exterior walls, gutters and downspouts shall be installed in such a manner that diverts the roof water away from the wall and the foundation. The diversion of water shall not create a public nuisance. The City Building Inspector shall approve the construction or repair of spouting, gutters and downspouts.
