For purposes of this Downtown Design and Maintenance Code, certain terms are defined as indicated herein. Any term not defined herein shall be as defined in the Zoning Code; or if not defined therein, as defined elsewhere in these Codified Ordinances; or if not defined therein, as defined in the Ohio Revised Code; or if not defined therein, as defined in Webster's New Collegiate Dictionary.
(a) Alteration. "Alteration" means the clearance, paving or improvement of a public or private site, public park, public right of way or other public area, or the erection, demolition, moving or enlargement of a structure thereupon, but excluding:
(1) Routine maintenance and repairs that, in the interpretation of the City Manager or his or her designee, do not involve a significant change in the use or appearance of the property as viewed from a public area; and
(2) Any action required, in the judgment of the City Manager or his or her designee, for public safety because of immediate peril to life, health or property.
(b) Street Furniture. "Street furniture" means man-made objects, other than buildings, that are located on public streets or sidewalks, such as litter containers, planters, benches, public telephones, traffic signals, newspaper racks, bicycle racks, utility poles and kiosks.
