(a) No tomb or private mausoleum shall be constructed within the limits of the cemetery except by permission of the City Manager or his designee, and only in such places and in such manner as he or she may direct:
(1) Placement. The City Manager or his designee shall have full discretion as to the placement of a private mausoleum within the cemetery.
(2) Plan review. All construction plans of a private mausoleum shall be reviewed by the City Manager or his designee prior to construction. Construction plans shall be submitted to the City Manager or his designee prior to purchase of lot.
(3) The mausoleum shall not be constructed or installed by the City.
(4) Building specifications. All mausoleums shall include footings below the frost line. All footings shall be constructed with poured concrete on site.
(5) Disclaimer. The cemetery and the City shall not be liable for any claims or actions arising out of the construction, erection or materials of the mausoleum installed and constructed by a private contractor.
(b) The land adjacent to the mausoleum on the lots purchased may be used for the burial of cremains, with approval of the City Manager or his designee. Flat individual markers may be used to identify the location and name of the cremains.
(c) The City Manager or his designee reserves the right to reject any plan submitted even though these rules are met, if the aesthetics or structural conditions of the mausoleum are not acceptable.
(d) All maintenance responsibility of the private mausoleum shall be performed by the owner or the owner’s next of kin, or authorized contractor of the owner of the owner’s next of kin.
