919.06   RESPONSIBILITY OF OWNERS FOR MAINTENANCE OF PRIVATE STORMWATER FACILITIES AND DRAINAGE ON PRIVATE PROPERTY.
   (a)   Any owner or possessor of private property upon which stormwater drainage facilities, whether man-made or natural, exist for the purpose of collecting, conveying, retaining or detaining stormwater within that property, and which are not public facilities pursuant to Section 919.07, shall be responsible for the maintenance of these facilities to ensure proper operation.
   (b)   The City and/or the Stormwater Management Utility shall not be responsible for resolving drainage problems on private property where such problems pose a nuisance, do not impact the operation of the overall stormwater management system of the City or do not involve the function of public facilities as provided by Section 919.07. Private property owners bear the responsibility to remedy these types of problems. The City and/or the Utility may cooperate with private property owners to extend public facilities of the stormwater management system to the private property, to enable the resolution of these drainage problems, if Council decides that suitable resources are available and that the project can be accommodated within the context of the City's overall capital improvement plan, and if the City Engineer determines that the City's stormwater management system is capable of handling any additional flows that may be placed in the system as a result of implementing the proposed solution.
