(a) It shall be the duty of every abutting lot owner to keep in good repair:
(1) Any sidewalk or parts thereof within the City.
(2) Curbs and gutters adjacent to and in front of driveways in accordance with the driveway permit issued by the City of Sidney Engineering Department.
(b) It shall be the responsibility of the City to maintain all curbs and gutters, once installed in the City right-of-way. Exceptions to this maintenance responsibility are:
(1) Curbs and gutters adjacent to and in front of driveways.
(2) Curbs and gutter required by the City Zoning Board or site development permits.
(c) City Council shall determine the timing of maintenance of curbs and gutters.
