131.09   PROMOTIONS.
   (a)   Police. All promotional appointments, except for the Police Chief’s position, made pursuant to Ohio R.C. 124.44, shall be for a probationary period of six months, and no promotion is final until the appointee has satisfactorily served the probationary period. If the service of the probationary employee is unsatisfactory, the employee shall be reduced to the rank the employee held at the time the employee was appointed to the higher rank. Promotions to the position of Police Chief will be made pursuant to the City Charter.
   (b)   Fire. All promotional appointments in the Fire Department, except for the Fire Chief’s position, made pursuant to the Ohio Revised Code, shall be for a probationary period of six months. No promotion shall be deemed final until the appointee has satisfactorily served the probationary period. At the end of the probationary period, the Fire Chief shall transmit to the City Manager a record of the employee’s service, and if such service is satisfactory, the employee shall continue in their promotive rank. If at the end of the probationary period the appointee’s service is unsatisfactory, the employee shall be reduced to the rank held at the time the employee was appointed to the higher rank. In all cases of unsatisfactory probationary periods in the Fire Department, the Fire Chief shall at the end of the probationary period, furnish the employee with a written notice of unsatisfactory probation and a detailed statement of the basis for such findings. Within ten days thereafter, such employee may appeal from the decision or order of the City Manager to the Municipal Civil Service Commission, and the Commission may hear, or appoint a trial board to hear such employee’s appeal within thirty days from its filing with the Commission. An appeal to determine the sufficiency of the cause of demotion may be had from the decision of the Civil Service Commission to the Court of Common Pleas of the County in which such Municipality is situated. Such appeal shall be taken within twenty days from the decision of the Commission. Promotions to the position of Fire Chief will be made pursuant to the City Charter.
   (c)   Others. In order to provide advancement opportunity, when vacancies exist, the Human Resources Manager will post a list of such vacancies indicating the title, description of duties, basic personnel requirements, normal work schedule and rate of pay. An interested employee may apply for such vacancy by filing with the Human Resources Manager an employment application declaring their desire for a promotion. Such application shall list the employee’s qualifications. Placement and advancement shall be at the City’s discretion and the City shall consider the employee’s experience, work history, qualifications and seniority in filling vacancies. The City reserves the right to fill vacancies from outside sources when in the best interest of the City as determined by the City Manager. All promotional appointments shall be probationary and subject to a probationary period of six months after appointment. An employee promoted and then rejected during a probationary period shall have the right to resume the position from which they were promoted. Employees in their initial probationary period with the City are not eligible for promotion in the same or other departments, unless approved by the City Manager.
   (d)   Salary Adjustments. Any adjustment to the salary shall be made in accordance with Section 131.12.
