13.04.112: WATER AND SEWER VACATION FEE:
   A.   A reduced fee for sewer and water service to residential properties in the city is available for residential properties, which shall be vacant for a period of time not less than three (3) months.
   B.   An individual requesting the vacation sewer and water rate shall make application for said rate to the city on a form to be provided by the city clerk.
   C.   Sewer and water vacation rate shall be fifteen dollars ($15.00) per month.
   D.   All applicants for a vacation rate shall certify that the residential property for which the vacation rate is requested will be vacated, and not used by any individuals, during the period requested. Any individual who violates the provisions of this section regarding the nonuse of the property for which the vacation rate has been granted, shall result in the full water and sewer and monthly fee being imposed for the period in which a violation has been discovered.
   E.   If an application is made for a water and sewer vacation rate to begin on a date other than the beginning of the normal monthly billing cycle, the city clerk shall prorate the vacation fee for the period of time from the date requested by the applicant to begin the vacation fee and the date of the next normal monthly billing cycle.
   F.   The city clerk shall have the power to approve or deny all applications for sewer and water vacation rates.
   G.   An individual whose application for sewer and water vacation has been denied shall have the right to appeal such denial to the city council by filing a written notice of appeal no later than ten (10) days after the date of the denial of the application. The city council shall hear the applicant's appeal no later than the next regularly scheduled meeting after the date of the applicant's appeal being filed.
   H.   The sewer and water vacation rate may be amended by the city council by resolution. (Ord. 461, 1999 1 )
