5-2-12: REQUIREMENTS FOR POSSESSION OF A VICIOUS DOG:
   A.   Village dog warden or any Village police officer has the authority to impound a vicious dog. No vicious dog shall be released to the owner unless and until the Village dog warden or a Judge of the Circuit Court orders such release.
   B.   No person shall keep or maintain any dog in the Village of Shorewood which has been found to be a vicious dog, even if such finding was rendered in another jurisdiction of similar or more stringent regulations regarding vicious dogs. Upon violation of this chapter, the dog shall be immediately impounded by the Village dog warden or his designee or a Village law enforcement officer. The dog shall be destroyed if the owner does not appeal the impoundment within fifteen (15) days.
   C.   A vicious dog may not be sold, residency relocated, or given away without first providing notice to the Village dog warden.
   D.   It shall be unlawful for any owner or custodian to fail to comply with a vicious dog determination, or with restrictions or penalties imposed by the Village dog warden or the Circuit Court upon a vicious dog determination.
   E.   Failure to comply with this chapter may result in the destruction of the dog.
   F.   As stated in section 26 of the Animal Control Act 1 , if the owner of a vicious dog subject to enclosure: 1) fails to maintain or keep the dog in an enclosure or fail to spay or neuter the dog within the time period prescribed; and 2) the dog inflicts serious physical injury upon any other person or causes the death of another person; and 3) the attack is unprovoked in a place where such person is peacefully conducting himself or herself and where such person may lawfully be, the owner shall be guilty of a Class 3 felony, unless the owner knowingly allowed the dog to run at large or failed to take the steps to keep the dog in an enclosure then the owner shall be guilty of a Class 2 felony.
