It shall be unlawful to commit cruelty to any dog. For the purpose of this chapter, cruelty to a dog shall be considered to be:
A. Knowingly hitting, tormenting, mutilating or killing any dog;
B. Willfully failing to provide any animal with proper food, drink or shelter; or
C. Abandoning any old, maimed, infirm, sick or disabled dog.
Any person or persons who shall be convicted of willfully failing to provide a dog in his charge or custody, as owner or custodian, with proper food, drink or shelter may be required to pay a fine pursuant to section 5-2-14 of this chapter, and may be assessed such reasonable charges incurred by any person or persons providing food, care or shelter for such dog.
