4-2-6: INJURIOUS SUBSTANCES, CEMENT, FREEZING WATER:
   A.   Deposits Prohibited: No person shall deposit snow, ice, bottles, cans, glass, nails, wire, ready mix concrete, debris or any other substance likely to injure any person, animal or other vehicle upon any public sidewalk, alley, parkway, private lot (without permission of owner), right of way or street or likely to impede the orderly flow of pedestrian and vehicular traffic nor shall any person deposit or discharge water in freezing weather upon any public sidewalk, alley, right of way or street which might or could cause ice to form thereon. No person shall wash out or deposit concrete upon any sidewalk, parkway, street, alley or private lot without written consent of said owners of record. Ready mix concrete delivery vehicles must wash out at point of delivery or at a designated place within the subdivision established by the developer.
   B.   Removal Of Prohibited Deposits: Any person who places, deposits or drops, or permits to be placed, deposited or dropped, upon any sidewalk, alley, right of way or street, any substance or material prohibited by subsection A of this section, shall immediately remove the same or cause it to be removed.
   C.   Application Of Provisions; Nonliability: This section shall not be applicable to and shall not create any liability upon the state, any unit of local government, any school district or any officer or employee thereof who may violate the terms hereof in the performance of their governmental or municipal duties.
   D.   Penalty: Any person violating the provisions of this section shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00). (Ord. 87-450, 11-24-1987)
