1-5-5: INDEMNIFICATION OF VILLAGE OFFICERS AND EMPLOYEES:
To the extent permitted by law, whenever any elected or appointed officer or official, including the village president, village clerk, village trustees, village treasurer, village administrator and any village employees, full or part time, including, but not limited to, members of the police department, commits an act or omission or takes an action while acting within the scope of his office or employment, and said act or action is done in furtherance of his duties of office or employment, and the official or employee is thereafter sued in any civil tribunal or administrative body for money damages or other relief, the village shall bear the entire expense of defending said village official or employee before said tribunal and shall indemnify the village official or employee for and pay any money judgment (excluding punitive damages) entered against him, whether or not the village official still holds elected office or remains employed by the village at the time the proceedings are commenced against him. The elected official or employee may, with the consent of the corporate authorities, employ legal counsel of his own choosing at the village's expense to defend his interests. This section shall not be construed to require the village to pay any expenses of the village official associated with the defense of a purely criminal charge lodged against him; provided further, that this section shall not be construed to require the village to pay any expenses associated with the defense of any disciplinary proceeding to suspend, terminate or otherwise discipline any village officer, official or employee.
