401.16 CONDITIONS OF LICENSE.
   Every license is subject to the conditions in the following subdivisions and all other provisions of this chapter and of any other applicable ordinance, state law or regulation.
Subd. 1.   Conduct of business. Every licensee is responsible for conduct of his or her place of business and the conditions of sobriety and order in it. The act of any employee on the licensed premises authorized to sell intoxicating liquor therein is deemed the act of the licensee as well, and the licensee shall be liable to all penalties provided by this chapter and the law equally with the employee.
Subd. 2.   License to be posted. All licensed premises shall have the license posted in a conspicuous place at all times.
Subd. 3.   Sales to certain persons restricted. No alcoholic beverage shall be sold or served to any intoxicated person or to any person under 21 years of age.
Subd. 4.   Minors on the premises.
      a.   No person under the age of 18 years shall be employed in any rooms constituting the place in which intoxicating liquors or 3.2% malt liquor are sold at retail on-sale, except that persons under the age of 18 may be employed as musicians or to perform the duties of a bus person or dishwashing services in places defined as a restaurant, hotel, motel or other multipurpose building serving food in rooms in which intoxicating liquors or 3.2% malt liquor are sold at retail on-sale.
      b.   No person under the age of 21 years may enter a licensed establishment except to work, consume meals on premises that qualify as a restaurant, or attend social functions that are held in a portion of the premises where liquor is not sold.
Subd. 5.   Gambling or gambling devices. No gambling or any gambling device shall be permitted on any 3.2% licensed premises.
Subd. 6.   Display during prohibited hours. No "on-sale" establishment shall display liquor to the public during hours when the sale of liquor is prohibited.
Subd. 7.   Inspections. Every licensee shall allow any peace officer, health officer or properly designated officer or employee of the city to enter, inspect and search the premises of the licensee during business hours without a search and seizure warrant and may seize all intoxicating liquors found on the licensed premises.
