For the purpose of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
“CHRONIC VIOLATIONS.”
(1) A single occurrence resulting in a charge of violating any provision of Chapter 506 of the Kentucky Revised Statutes;
(2) A single occurrence resulting in a charge of violating KRS 507.020 or 507.030;
(3) A single occurrence resulting in a charge of violating KRS 508.010, 508.020, 508.025, 508.075, 508.078 or 508.060;
(4) Two or more occurrences within a twelve (12) month period resulting in charges of violating KRS 508.030, 508.040, 508.070 or 508.080;
(5) A single occurrence resulting in a charge of violating any provision of Chapter 510 of the Kentucky Revised Statutes;
(6) Three or more occurrences within a twelve (12) month period resulting in charges of violating KRS 511.060, 511.070 or 511.080;
(7) Three or more occurrences within a twelve (12) month period resulting in charges of violating any provision of Chapter 512 of the Kentucky Revised Statutes, except that a single occurrence involving the sale or manufacture of methamphetamine shall constitute a “CHRONIC VIOLATION”;
(8) Three or more occurrences within a twelve (12) month period resulting in charges of violating any provision of Chapter 514 of the Kentucky Revised Statutes;
(9) A single occurrence resulting in a charge of violating any provision of Chapter 515 of the Kentucky Revised Statutes;
(10) Three or more occurrences within a twelve (12) month period resulting in charges of violating one (1) or more provisions of Chapters 525, 528 or 529 of the Kentucky Revised Statutes;
(11) A single occurrence resulting in a charge of violating any provision of Chapter 527 of the Kentucky Revised Statutes;
(12) The issuance of three (3) or more code enforcement notice of code violation letters to a single property owner within a twelve (12) month period;
(13) The issuance of two (2) or more citations for violating any provisions of Chapter 94 of this code of ordinances within a twelve (12) month period;
(14) Two or more occurrences within a twelve (12) month period resulting in charges of violating any provision of Chapter 218A of the Kentucky Revised Statutes; or
(15) Any combination of two or more of the above occurring within a twelve (12) month period.
“OCCURRENCE.” An event taking place on any area of a parcel of property owned, leased, occupied or subject to the control of by the person charged with creating the chronic nuisance, regardless of whether such person was directly or indirectly involved in the event. It is the conduct of permitting these occurrences to take place at businesses in the city that is regulated by this subchapter.
“PERSON.” Includes an individual, partnership, corporation, unincorporated association or any other legal entity recognized pursuant to state law.
