§ 99.99 PENALTY.
   (A)   It is hereby found and determined that more than two (2) unwarranted alarms within any calendar year is excessive and constitutes a public nuisance. A Board citation shall be issued to an alarm user accruing three (3) or more unwarranted alarms within any calendar year, and if determined by the Board to be in violation, shall pay a fee to the city of fifty dollars ($50) for the third unwarranted alarm and each unwarranted alarm thereafter.
   (B)   In addition to the fee for unwarranted alarms, alarm users shall pay a civil penalty for the third and subsequent unwarranted alarms within any calendar year according to the following rates:
      (1)   Third unwarranted alarm, fifty dollars ($50);
      (2)   Fourth unwarranted alarm, seventy five dollars ($75); and
      (3)   Fifth unwarranted alarm, and all unwarranted alarms thereafter, one hundred dollars ($100) per unwarranted alarm.
   (C)   The fees and civil penalties collected shall be payable to the city and shall be deposited by the city in its general fund to be budgeted as a part of the city’s general fund income.
   (D)   Any alarm user who fails to register pursuant to § 99.02 shall pay a civil penalty of fifty dollars ($50) in addition to any other fees or civil penalties provided herein.
