§ 125.01 BUSINESS REGULATIONS.
   (A)   Definitions. As used in this chapter, the following term shall have the following meaning, unless the context clearly indicates that a different meaning is intended.
      "TEMPORARY/PERIODIC BUSINESS." A business for profit operated without a structure or from a temporary or portable structure not affixed to the real estate and for less than six days per week on a vacant lot or on a portion of a lot of real estate occupied by a larger permanent structure for residential use or the operation of a business.
   (B)   It shall be unlawful for a temporary periodic business to operate in the city in violation of zoning restrictions.
   (C)   It shall be unlawful for a temporary/periodic business to operate without having previously obtained an appropriate business license from the city. As a condition precedent to the grant of a business license, the business activity/location shall receive a certificate of compliance from the City Clerk.
   (D)   It shall be unlawful for a temporary/periodic business to operate in such manner as to cause hazardous traffic conditions, fire hazards, violations of air quality standards or noise ordinances, nuisance ordinances or any other activity which may be detrimental to public health.
   (E)   Non-compliance with this chapter shall be cause for the revocation of business license heretofore issued to the offending owner or operator of said business.
   (F)   Any person, firm or other entity in violation of this chapter shall be guilty of a criminal violation or a civil violation. Criminal violations may be prosecuted in the Jefferson district court and the fine for conviction shall be not less than $50 dollars nor more than $500 dollars. Civil violations may be tried before the Shively Code Enforcement Board and the penalty for violation shall be not less than $50 dollars nor more than $500 dollars. Each violation may be considered a separate offense.
