§ 130.04 OBSCENITY.
   (A)   It shall be unlawful for any person, firm, or corporation to distribute, sell, give away, or deliver to any other person, firm, or corporation within the city.
      (1)   Any obscene, lewd, lascivious, or filthy book, pamphlet, picture, motion picture film, paper, letter, writing, print, or other matter of indecent character; or
      (2)   Any obscene, lewd, lascivious, or filthy phonograph recording, electrical transcription, or other article or thing capable of producing sound.

   (B)   Material is obscene when the average person, applying contemporary community standards, would find that the work taken as a whole, appeals to the prurient interest; the work depicts or describes, in a patently offensive way, sexual conduct specifically defined by applicable law; and the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.
