§ 123.03 OPERATIONAL REQUIREMENTS.
   (A)   A junkyard shall be operated, maintained or conducted entirely inside an enclosed building or buildings or on premises enclosed by a fence and:
      (1)   All such fences shall be made of such materials as to completely screen from view the contents of the junkyard. Screening may be provided by, but not limited to, chain link fences with panel weave, wood or galvanized steel fences;
      (2)   All such fences shall be no less than eight (8) feet nor greater than twelve (12) feet in height;
      (3)   All such fences shall be of similar composition, construction and color throughout;
      (4)   All such fences shall be maintained in a neat, substantial and safe condition, and shall not be allowed to deteriorate;
      (5)   All such fences shall have gates which conform to the same standard as those for fences and shall swing inwardly. Such gates shall be kept closed and locked when the junkyard is not open for business;
      (6)   All such fences shall be set back no less than five (5) feet from any property line, public or utility easement, sidewalk or any public right-of-way;
   (B)   A junkyard shall comply with the following operational requirements:
      (1)   All business of the junkyard shall be transacted on the premises and none of the contents of the junkyard, subject to the control of the owner or operator, shall be allowed to remain outside the area enclosed by the building or the fence.
      (2)   The contents of a junkyard shall not be placed or deposited to a height greater than one foot below the height of the enclosing fence or eleven (11) feet, whichever is less. However, higher elevations of land inside the junkyard may only be used if either the exterior or an additional interior fence completely screens the contents from the view of a person six (6) feet in height standing on the same ground elevation as the exterior fence is located and fifty (50) feet in distance therefrom.
      (3)   The contents of a junkyard shall not be placed or deposited closer than three (3) feet to the enclosing fence.
      (4)   No junkyard or part of a junkyard shall be allowed to operate on a slope greater than twelve (12) degrees.
      (5)   All junkyards shall include clear spaces or fire lanes to allow fire and safety personnel and equipment to function effectively on the premises. Clear spaces or fire lanes shall be provided in the following manner:
         (a)   The space occupied by any collection of the contents of the junkyard shall not be greater than forty (40) feet by two hundred (200) feet.
         (b)   Any collection of the contents of the junkyard shall be separated from any other collection by a clear space or fire lane of not less than eighteen (18) feet.
         (c)   Any collection of the contents of the junkyard shall be separated from any building of an adjoining property by a clear space or fire lane of not less than eighteen (18) feet.
      (6)   All anti-freeze, gas, oil, batteries, Freon, or other flammable liquids shall be drained and removed from all junk vehicles, or parts thereof, or vehicles’ frames. Such fluids shall be collected, stored and disposed of in accordance with applicable federal, state and local statutes, ordinances and regulations pertaining thereto.
      (7)   No junkyard shall be allowed to accumulate on the premises more than fifty (50) tires that are not mounted on a wheel and attached to a vehicle.
