§ 94.72 PENALTY FOR VIOLATION.
   (A)   Violation of this chapter shall constitute a criminala violation for which a citation may issue returnable to District Court with a fine to be assessed for each violation consistent with subsection (B) of this section, or at the option of the city, and in addition to the foregoing, a violation shall constitute a civil offense and shall be enforced pursuant to the provisions of Chapter 41.
   (B)   Any person, firm, corporation or entity in violation of this subchapter shall be guilty of a misdemeanor and upon conviction thereof in the District Court of Jefferson County, be subject to a fine of not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00) or imprisoned in the county jail for not more than six (6) months. Each day on which a violation occurs shall constitute a separate offense.
   (C)   The civil penalty for violating this subchapter shall be not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00). Each day's violation shall constitute a separate offense. This subchapter is subject to enforcement by the Code Enforcement Board of the city.
