§ 94.46 PENALTY FOR VIOLATION.
   (A)   Any owner, his agent or occupant, who has been sent notice of violation or failed to abate the condition may be charged with a violation of this subchapter in a criminal complaint returnable to Jefferson District Court with a fint to be assessed for each violation consistent with subsection (B) of this section, or at the option of the city, and in addtion to the foregoing, a violation shall consitute a civil offense and shall be enforced purusant to the provisions of Chapter 41.
   (B)   Any owner, his agent or occupant, who violates any provision of this subchapter shall be guilty of a misdemeanor and shall be fined not less than twenty-five ($25.00) dollars or more than one thousand ($1,000.00) dollars; or imprisoned in the county jail for not more than fifty (50) days, or both, for each offense. Each day in which any violation occurs shall constitute a separate offense.
   (C)   The civil penalty for violation of this subchapter regarding weeds shall be as set forth in § 41.12. The civil penalty for violating this subchapter except in relation to weeds shall be not less than one hundred dollars ($100.00) nor more than one thousand dollars ($1,000.00). Each day's violation shall constitute a separate offense. This subchapter shall be subject to enforcement by the Code Enforcement Board of the city.
   (D)   Any person who violates any provision of this subchapter may become individually liable to the city for the cost described in § 94.44 thereof, but also for all costs, expenses, attorney fees and/or civil damages incurred by the city to enforce the provisions of this chapter, for each parcel of real property found to be in violation for those periods as charged.
