§ 91.18 NOISE DISTURBANCE.
   (A)   It shall constitute a nuisance and is declared illegal for any owner, agent, occupant, firm, or corporation within the city limits to permit dogs on any premises, whether residential or commercial, when the dogs by reason of barking, howling, or yelping, seriously annoy and disturb the residents of neighboring property to the extent that the neighbors are disturbed in the use and enjoyment of their property.
   (B)   The keeping of three or more dogs on such premises shall be presumed to constitute a nuisance and violation of this section.
   (C)   If any owner, agent, occupant, firm, or corporation within the limits of the city shall permit or suffer the conditions described in divisions (A) and (B) above, the Police Department shall order the owner, agent, occupant, firm, or corporation thereof, to remove the same at the expense of said owner, agent, occupant, firm, or corporation within 20 calendar days. The notice shall be served by a police officer directly to the owner, agent, occupant, firm, or corporation. If the owner, agent, occupant, firm, or corporation shall fail to comply with the requirements of the notice, the Police Department shall proceed to have the nuisance removed or abated from the premises and report the cost thereof to the proper authority, which shall then assess the sum against the property.
