§ 73.15 DEFINITIONS.
   For the purpose of this subchapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   “MOPED.” Either a motorized bicycle whose frame design may include one or more horizontal cross bars supporting a fuel tank, so long as it also has pedals; or a motorized bicycle with a step-through type frame which may or may not have pedals rated no more than two brake horsepower, a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged, and is capable of a maximum speed of not more than 30 miles per hour.
   “OPERATOR.” Any person in actual control of a moped while the moped is in operation or capable of being operated.
   “OWNER.” A person who holds the legal title of a moped, including but not limited to an individual who has possession of the vehicle with the right of purchase upon performance of conditions stated in an agreement or conditional sales contract.
   “RESIDENT.” A person who resides in the city for longer than 60 days.
