§ 71.14 GOLF CARTS AND/OR OFF-ROAD VEHICLES.
   (A)   Registration and inspection fee. A valid, current registration/inspection sticker must be affixed to the golf cart and/or off-road vehicle as defined by Indiana Code at all times while operating on town streets. An annual inspection fee of the inspection is $15 and shall be paid to the Town Marshal's office. At the time of payment, the Marshal's office, before issuing the annual registration/inspection sticker, will inspect the vehicles safety equipment and confirm that it is operational and satisfactory to comply with the town ordinance and shall further confirm at the time of inspection the existence of financial responsibility. The annual inspection sticker must be displayed on the front of the vehicle in a visible location.
   (B)   (1)   The use of a golf cart upon the streets and alleys of the town is permitted pursuant to I.C. 21-1-3.3 et. seq. Golf cart means a four-wheeled motor vehicle originally and specifically designed and intended to transport one or more individuals and golf clubs, for the purpose of playing the game of golf on a golf course.
      (2)   An off-road vehicle or all-terrain vehicle is defined under I.C. 14-8-2-233.5 and 14-8-2-5.7. This section does not apply to an electrical personal assistive mobility device in accordance with I.C. 9-21-9-0.5.
   (C)   A golf cart operated on the streets and alleys of the town shall at all times display either a slow moving vehicle emblem in accordance with I.C. 9-21-9-3 or a red or amber flashing lamp.
   (D)   A golf cart or off-road vehicle operated on the streets and alleys of the town shall at all times be operated by an individual who possesses a valid state issued driver's license.
   (E)   No golf cart or off-road vehicle is to be driven or parked on any sidewalk in the town.
   (F)   A person who violates this section shall receive a warning for the first offense. A person who violates this section within a calendar year of the warning shall be fined $250. A person who violates this section a subsequent time within a calendar year of the warning or the subsequent offense shall be fined the sum of $500. Each day of violation constitutes a separate violation.
   (G)   All fines collected pursuant to division (F) shall be deposited in the general fund of the town.
