(A) A user fee of $10 per month is hereby established for trash collection beginning January 1, 2017 for all town residents and any business that may qualify for trash collection per town ordinance.
(B) Unpaid fees may be assessed by the town against real property provided in I.C. 36-9-23-31 through 36-9-23-34. If fees assessed against real property are not paid within 20 days, a penalty of 10% of the amount of the garbage fees attaches to the delinquent fees consistent with the utilities billing and collections processes for all utilities. The fee amount, the penalty and reasonable attorney’s fees may be recovered in a civil action in the name of the municipality.
