§ 52.17 STORM WATER DISTRICT.
   (A)   Purpose. This section is necessary for the protection of the public health and welfare of the inhabitants of the Shirley Storm Water District and the safeguarding of the property within the District, and its adoption is of public utility and benefit.
   (B)   Authority.
      (1)   The rates and charges authorized herein are in accordance with I.C. 36-9-23-1 et seq.
      (2)   Accordingly, the rates and charges authorized herein have been recommended by resolution of the Department of Storm Water Management, and approved by ordinance of the Town Council.
      (3)   The rates and charges authorized herein shall be billed on the first billing cycle of the town’s utilities after approval of such ordinance by the Town Council.
   (C)   Monthly storm water utility and user fee.
      (1)   The monthly storm water utility and user fee will be $5 per month for each single-dwelling unit, each non-residential unit, and each residential/business unit.
      (2)   The monthly storm water utility and user fee will be charged to all residential, non-residential, and combined residential/business properties.
         (a)   The monthly user fee will be uniform for each residential, each nonresidential and each combined residential/business unit.
         (b)   This allocates that all residential, business and other uses of property in the town place demands on the storm water system and benefit from the storm water activities.
      (3)   (a)   Any connection to the storm water system will cause a charge of time and materials for such connection.
         (b)   Any connection to the system shall include an inspection fee of $25 and connection to the system shall be time and materials and cost to make such a connection.
   (D)   Late charge. If the monthly storm water utility fee is not paid by the due date stated on the bill, a late charge of 10% will be assessed, together with costs of collection, if any, including reasonable attorney’s fees.
   (E)   Partial payments. Partial payments on the monthly utility bills shall be paid and applied as follows:
      (1)   First to the water fee;
      (2)   Second to the storm fee;
      (3)   Third to the trash fee; and
      (4)   Fourth to the sanitary sewer fee.
