8-5-2: OVERHEAD FACILITIES PROHIBITED:
The village requires that main traffic corridors, entrances to developments and shopping areas, and highly visible public areas be free from overhead utility lines, utility poles, communication towers, and other associated overhead utility structures as provided in section 8-5-1 of this chapter, except as follows:
   A.   Temporary and emergency utility lines shall not be subject to underground installation requirements. For the purpose of this section, a "temporary utility line" will be defined as an installation that will be in place less than twelve (12) months.
   B.   Utilities, subdividers, developers or owners may petition the village for an exception to the underground installation requirements for new utilities on a case by case basis as follows:
      1.   The village board shall have sole authority to hear and grant underground utility installation exceptions. Among other factors, the village board will consider the following criteria when judging underground utility installation exceptions:
         a.   Location of the proposed utility.
         b.   Visibility of the utility from high traffic locations.
         c.   Existing and proposed use of the adjacent property.
      2.   All petitions for underground installation exception shall include the following documents:
         a.   Location map showing the utility installation.
         b.   Detailed submission of pole heights, pole type and material, spacing of poles, structure height, and all other pertinent information.
         c.   Ground level photographs of the existing area where utility poles and structures will be installed.
         d.   Detailed discussion of the reason(s) for construction of aerial rather than underground installation. (Ord. 2010-19, 12-21-2010)
