§ 36.01 STATUTORY AUTHORITY.
   The provisions of this chapter are enacted pursuant to and subject to any limitations provided by state law pursuant to the general powers of a town to provide for the public safety, peace and order in accordance with IC 36-8-2 and pursuant to all general and residual powers of a town under IC 36-1-3. The special powers and regulations provided herein shall be actualized and in effect when:
   (A)   A general state of civil emergency is declared by the Governor of the state, affecting the area in which the town is located, to the extent that the special powers or regulations are not inconsistent with the orders of the Governor or an applicable statewide disaster plan; or
   (B)   A local state of civil emergency is declared by the President of the Town Council pursuant to state law, but the special powers and regulations shall not remain in effect unless the Town Council, by a majority vote, agrees and consents to a further continuance.
